¿Cuáles son los motivos por los que debe reemplazar una tarjeta verde perdida o robada?
Su tarjeta verde sirve como evidencia de identidad y de su condición migratoria en EE.UU. Si no tiene una tarjeta verde válida, puede tener problemas. No tener una tarjeta verde válida en todo momento se considera un delito menor. Debe usarla para demostrar evidencia de su derecho a trabajar en EE.UU. cuando solicite un empleo, o cuando su empleador actual le solicite una copia.
¿Quiénes son elegibles para utilizar el formulario I-90 de USCIS a fin de reemplazar una tarjeta verde?
Tanto los residentes permanentes (con tarjetas verdes de diez años) como los residentes permanentes condicionales (con tarjetas verdes de dos años) pueden utilizar el formulario I-90 con los siguientes propósitos:
- Reemplazar una tarjeta verde extraviada, robada o dañada;
- Solicitar una tarjeta verde si el USCIS les otorgó una, pero nunca la recibieron;
- Solicitar un reemplazo de la tarjeta verde si la que tienen contiene un error que debe corregirse;
- Solicitar un reemplazo de la tarjeta verde debido a que cambiaron legalmente su información biográfica, Ej: el nombre.
Si Usted es residente permanente condicional, ¿Puede utilizar el formulario I-90 de USCIS para reemplazar la tarjeta verde perdida o robada?
Los residentes permanentes condicionales son personas que tienen una tarjeta verde de dos años. Usted puede tener una tarjeta verde condicional si la recibió por matrimonio o por una actividad empresarial.
Si es residente permanente condicional, no puede utilizar el formulario I-90 para renovar la tarjeta verde. En su lugar, antes de que expire su tarjeta verde, debe solicitar que se eliminen las condiciones sobre su residencia permanente. Si se aprueba su solicitud, recibirá una tarjeta verde no condicional de 10 años.
Es MUY IMPORTANTE que envíe la petición para eliminar las condiciones antes de que la tarjeta verde condicional expire. Si la tarjeta verde expira antes de enviar esta solicitud, podría perder la condición de residente permanente e incluso podrían obligarlo a abandonar EE.UU.
