¿Cuáles son los motivos por los que debes reemplazar la tarjeta verde?
Tu tarjeta verde sirve como evidencia de identidad y de tu condición migratoria en EE.UU. Si no tienes una tarjeta verde válida, puedes tener problemas. No tener una tarjeta verde válida en todo momento se considera un delito menor. Debes demostrar evidencia de tu derecho a trabajar en EE.UU. cuando solicites un empleo, o tu empleador actual también puede solicitar copia de ella.
Quiénes son elegibles para utilizar el Formulario I-90 del USCIS a fin de reemplazar una tarjeta verde
Tanto los residentes permanentes (aquellos que tienen tarjetas verdes de diez años) como los residentes permanentes condicionales (aquellos que tienen tarjetas verdes de dos años) pueden utilizar el Formulario I-90 con los siguientes propósitos:
- Reemplazar una tarjeta verde extraviada, robada o dañada;
- Solicitar una tarjeta verde si el USCIS les otorgó una, pero nunca la recibieron;
- Solicitar un reemplazo de la tarjeta verde si la que tienes contiene un error que debe corregirse;
- Solicitar un reemplazo de la tarjeta verde debido a que cambiaron legalmente tu información biográfica, como el nombre.
Los residentes permanentes también pueden utilizar el Formulario I-90 para solicitar una tarjeta verde especial si van a obtener la condición de viajero frecuente, si cumplirán 14 años, o si se convirtieron automáticamente en residentes permanentes de EE.UU.
Si eres residente permanente condicional, ¿puedes utilizar el Formulario I-90 del USCIS para reemplazar tu tarjeta verde o para obtener un reemplazo de la tarjeta verde?
Los residentes permanentes condicionales son personas que tienen una tarjeta verde de dos años. Puedes tener una tarjeta verde condicional si recibiste la tarjeta verde por matrimonio o una actividad empresarial.
Si eres residente permanente condicional, no puedes utilizar el Formulario I-90 para renovar la tarjeta verde. En su lugar, antes de que expire tu tarjeta verde, debes solicitar que se eliminen las condiciones sobre tu residencia permanente. Si se aprueba tu solicitud, recibirás una tarjeta verde no condicional de diez años.
Es MUY IMPORTANTE que envíes la petición para eliminar las condiciones antes de que la tarjeta verde condicional expire. Si la tarjeta verde expira antes de enviar esta solicitud, podrías perder la condición de residente permanente e incluso podrían obligarte a abandonar EE.UU.
